Introduction

This website reerate.com, including any subdomains thereof, mobile applications, and application program interfaces (collectively, "Reerate") is owned, hosted, and operated by Reerate Technologies Pvt. Ltd. ("Company"), a company incorporated in India under the Companies Act, 2013. These terms and conditions, along with the Privacy Policy and community guidelines, constitute a legally binding agreement between Reerate and the User (the “Agreement”).

Reerate is an online information and communication service provided to you, subject to your compliance with the terms and conditions set forth below.

The Company may amend these terms and conditions at any time, and such modifications shall be effective immediately upon posting on Reerate. You should review these terms periodically to be aware of such modifications. Your continued access or use of Reerate shall be deemed conclusive proof of your acceptance of these terms, as amended. The Company may also suspend Reerate’s operation for support, technical upgrades, maintenance, content updates, or other reasons.

If you use Reerate in a manner inconsistent with these terms, the Company may terminate your access, block future access, and/or seek additional relief as deemed appropriate.

Definitions

Subscriber/User: Any person or legal entity who has subscribed to Reerate’s Services (paid or free) and accesses Reerate using a username and password, either assigned by Reerate, chosen by the Subscriber, or agreed upon. Only authorized Users may access the Services.

Browser/Visitor: A person who uses Reerate’s Services without creating an account, accessing non-restricted portions of Reerate.

Advertiser: A Subscriber/User uploading or relaying content using the Services.

Unauthorized User: Any person accessing Services without legal or contractual rights, subject to these terms, particularly regarding intellectual property and usage restrictions.

User/Customer: Includes both Subscribers/Advertisers and Browsers/Visitors.

Service(s): Interactive online information services offered by Reerate, including access to databases, search tools, and advertisement spaces (e.g., listings, banners). Reerate acts as a medium for information exchange, not as an agent for any User.

RERDA: Real Estate (Regulation and Development) Act, 2016, as amended, including its rules and regulations.

Submission and Administration of Listings/Advertisements

Users agree not to submit property descriptions, photographs, financial, contact, or other information to Reerate unless they have acquired all necessary rights and authorizations from the property owner or power-of-attorney holder, including from photographers or copyright owners of photographs, to publish and advertise the property on Reerate.

Reerate does not claim ownership of banners hosted on its platform, which are considered space sales. Reerate does not independently verify the authenticity or compliance of such content with applicable laws. Some listings may include third-party audio/video content ("AV Content") for informational purposes only, without constituting a recommendation or solicitation. No guarantees are made regarding the accuracy or completeness of AV Content.

Users consent to Reerate using submitted content for promotional, marketing, and publicity purposes without compensation. For voice samples or recordings provided for voiceovers in video listings, Users grant Reerate a royalty-free, irrevocable, worldwide, sublicensable, and transferable license to use, modify, and develop these samples as deemed fit.

Users covered under RERDA must obtain all requisite approvals, licenses, and permits from competent authorities for listed projects, lands, apartments, or plots, complying with all applicable laws. Users must disclose all material information required by law, including RERDA registration details, property status, encumbrances, dimensions, title, ownership, and possession. Reerate may require Users to provide supporting documents or affidavits to substantiate claims about property status.

Reerate may, at its discretion, search for and remove properties submitted in violation of these terms and may require additional evidence of compliance. Accounts of Users who repeatedly or intentionally violate these terms may be terminated. Users allow their property listings to be searched, displayed, accessed, downloaded, copied, or referenced by other users on Reerate or their websites. Reerate retains authority to determine how properties are displayed and may modify listings as needed.

Users represent and warrant that all properties and associated information are accurate and that listings are posted under the name of a duly authorized real estate agent engaged by the property owner. Reerate reserves the right to remove any properties posted without notice, consistent with reasonable commercial practices. Users are solely responsible for retaining backups of all submitted information, as Reerate takes reasonable efforts for data backup but assumes no liability for data loss.

Users buying or renting properties through Reerate must independently verify property details, including rights, title, ownership, and liens. The “verified” tag on Reerate indicates only the existence of the property as advertised, not verification of documentation, ownership, area, or pricing.

Content Moderation

Reerate employs proprietary and third-party AI tools to detect and address harmful content, including violations of platform terms or applicable laws (e.g., harmful speech). These tools may operate automatically or with human oversight, approving, rejecting, or escalating content for review. Users may raise grievances or appeal moderation decisions via Reerate’s grievance portal, with reviews conducted per established timelines, including human moderation where necessary.

These tools are part of a multi-layered moderation process provided “as is,” with ongoing refinements to ensure compliance with legal and platform standards. Reerate strives for accuracy and fairness but acknowledges no system is perfect.

Payment Terms

Payments for Reerate’s Services are on a 100% advance basis, non-refundable, and appropriated upon payment. Refunds, if any, are at Reerate’s sole discretion. Reerate may set off amounts paid by a User against amounts owed under other agreements. Reerate offers no guarantees for server uptime or application functionality, operating on a best-effort basis with liability limited to refund of paid amounts. Free Services carry no liability.

Reerate uses secure payment gateways for online transactions, not storing credit card data. Transactions occur on third-party networks, and Reerate is not liable for disclosure, errors, or inaccuracies in payment information. Refunds for failed transactions or objectionable content are at Reerate’s discretion and subject to delays due to third-party processing.

Video Community Guidelines

Users submitting video content for listings must comply with these guidelines:

Videos undergo human and technology-driven screening before going live. Violations result in removal. Videos may also be screened upon user reports or infringement claims, with removal if claims are valid. Reerate has final discretion on video screening and removal. Agents may edit or remove videos during the listing duration. Reerate may use third-party services (e.g., YouTube) for hosting, complying with their terms and policies.

Use of Information

Users agree to treat all information obtained from Reerate, including listings and member directories, as proprietary. Content reserved for members is confidential and protected as a trade secret. Reerate does not guarantee content accuracy, and Users use it at their own risk. Listings may be accessed only for initial information, limited to personal and internal use, not for distribution, publication, or derivative works. Users violating these terms, especially through abusive or excessive searching, face immediate account termination.

Intellectual Property Rights

All logos, brands, trademarks, and service marks on Reerate are owned or licensed by Reerate. Access to Reerate does not grant Users any license to use these marks, and unauthorized use is prohibited under Indian law. Reerate respects third-party intellectual property rights and may terminate accounts of Users infringing these rights. Users are granted a limited, non-exclusive, revocable license to access Services, provided they comply with these terms.

Restrictions/Prohibitions

The following actions constitute misuse of Reerate and are prohibited:

Users agree not to copy, distribute, or modify Reerate’s content for commercial gain or incorporate it into other works without consent. Violations may result in civil or criminal liability.

Links to Third-Party Websites

Reerate may link to third-party websites or resources. Reerate makes no representations about these sites, and Users access them at their own risk.

Disclaimer and Warranties

Reerate is an intermediary under Section 2(w) of the Information Technology Act, 2000. Content is provided “as is” and “as available,” without warranties of any kind. Reerate disclaims all implied warranties, including merchantability, fitness for purpose, or non-infringement. User views are their own, and Reerate does not endorse them. Users must evaluate content accuracy and usefulness independently. Reerate does not guarantee uninterrupted or error-free access or satisfactory responses to listings. Reerate is controlled from India, and Users outside India are responsible for local law compliance.

Limitation of Liability

Reerate is not liable for damages arising from use or inability to use the platform, including errors, interruptions, viruses, or data breaches. Liability includes no responsibility for technical malfunctions, communication failures, or unauthorized access. For Consumer Protection Act, 2019 purposes, “Consumer” refers to paid Customers using Services for non-commercial purposes. Reerate’s performance obligation is limited to providing portal access for the subscription period.

Termination

Reerate may terminate or restrict User access at its discretion, without notice, for violations of these terms or applicable laws.

Indemnification

Users agree to indemnify and hold Reerate, its affiliates, officers, and agents harmless from claims arising from their use of Reerate or breach of these terms, including legal and accounting fees. Reerate is not party to legal proceedings between Users but may recover costs if implicated.

Privacy Policy

Reerate’s Privacy Policy explains how personal data is used. Users can control visibility and contact preferences via settings. Feedback provided is non-confidential.

Terms for Users

By expressing interest in a listing or related services, Users authorize Reerate to contact them (despite NDNC/DNC registration) and share their profile with advertisers, who may contact them via phone, email, or WhatsApp. Reerate’s Privacy Policy does not govern third-party use of shared data. Reerate is not responsible for advertiser content or delivery methods. User applications and responses are processed and stored, even if a listing is no longer available. Publicly posted information may be accessed globally, and Reerate is not liable for third-party misuse. Users should avoid posting sensitive information publicly. Users may sign in via Facebook/Google, authorizing Reerate to access certain account information per the Privacy Policy.

Terms for Dealers/Builders/Banks/Payment Gateways

Entities processing personal data from Reerate must:

Arbitration

Disputes between Users and Reerate shall be referred to a sole, independent arbitrator in [Your City], India, under the Arbitration & Conciliation Act, 1996. The arbitrator’s decision is final and binding.

Severability

If any provision of these terms is invalid under law, it shall not affect the enforceability of other provisions.

Waiver

Reerate’s failure to enforce any right does not constitute a waiver of that right.

Governing Law and Jurisdiction

These terms are governed by Indian laws. Courts in [Your City], India, have exclusive jurisdiction.
